These Gaming Rules are submitted by MQ Realty Pty Ltd (Authority No. TP/05138) in compliance

with the requirement to lodge gaming rules with NSW Fair Trading at least 10 working days before

the trade promotion lottery commences.

  RULE 1 — THE PROMOTER

 

1.1        The promoter of this trade promotion lottery is MQ Realty Pty Ltd (ABN 62 165 899 481) (the Promoter). The Promoter’s registered office is 29–31 Joseph Street, Lidcombe NSW 2141. An additional office is located at Shop 207/62–80 Rowe Street, Eastwood NSW 2122.

1.2        This promotion is conducted under NSW Trade Promotion Authority Number TP/05138 issued by NSW Fair Trading on 4 June 2026, valid until 3 June 2027, subject to the Community Gaming Act 2018 and Community Gaming Regulation 2020 (NSW).

1.3        The Licensee-in-Charge responsible for the conduct of this promotion is Estate John Park (Real Estate Licence No. 1676301).

  RULE 2 — NAME AND DESCRIPTION OF THE LOTTERY

 

2.1        The trade promotion lottery is named: MQ Realty Investors Club 2026 Prize Draw (the Promotion).

2.2        The Promotion is conducted to promote the sale of off-the-plan apartments and land and house packages sold or marketed by MQ Realty Pty Ltd.

2.3        Entry is contingent upon making a qualifying property purchase as defined in Rule 5. There is no separate monetary entry fee.

 

  RULE 3 — PROMOTION PERIOD AND DRAW DATE

3.1        Deposits received before 15 June 2026 or after 31 January 2027 at 12:00 pm Sydney Time do not qualify for a draw entry.

3.2        Contracts not executed by 28 February 2027 do not qualify for a draw entry regardless of whether the deposit remains held.

3.3        The Promoter reserves the right to vary the draw date, time, or location by publishing notice on its social media channels or by providing written notice to all eligible participants prior to the draw date, in accordance with applicable NSW trade promotion requirements.

 

  RULE 4 — THE PRIZE

 

4.1  Prize Description

PRIZE CAP — IMPORTANT NOTICE

The prize is an vehicle with a maximum retail value of AUD $50,000 INCLUDING GST at the

time of vehicle delivery and includes on road cost. If the recommended retail price of the selected model exceeds $50,000

incl. GST at the date of delivery, the Promoter will select an equivalent model within the prize

cap. The Promoter may select either a Hyundai or Kia or other manufactures’ vehicle model within this cap.

The winner has no entitlement to any amount above $50,000 incl. GST.

 

4.2  What Is Included in the Prize

  • The purchase price of the vehicle up to the prize cap of AUD $50,000 including GST and which amount includes on road cost limited to registration, stamp duty and CTP green slip (GIO).
  • Standard dealer delivery from the authorised dealership to the winner’s nominated address within NSW only.

 

4.3  On-Road and Other Costs — MQ Realty Or Winner’s Responsibility

The following costs are includes Or NOT included in the prize and are the sole financial responsibility of the winner:

4.4  General Prize Conditions

4.4.1     The prize is not redeemable for cash, credit, or any alternative in whole or in part by MQ Realty.

4.4.2     The prize must be accepted as offered. No substitution is available to the winner.

4.4.3     The Promoter reserves the right to select either a Hyundai or Kia vehicle model within the prize cap of $50,000 incl. GST and all inclusions described above. The specific make, model, variant, and colour will be confirmed at or before the draw date, subject to dealer availability.

4.4.4     If the selected model is unavailable, the Promoter may substitute an equivalent vehicle of equal or lesser value within the $50,000 incl. GST prize cap, with prior notification to NSW Fair Trading.

4.4.5     The prize will be made available for collection or delivery within sixty (60) days of the winner formally accepting the prize in writing, subject to vehicle availability from the authorised dealership.

4.4.6     The prize remains the property of the Promoter until all required winner identification, prize acceptance documentation, and winner-payable on-road costs have been completed.

 

SETTLEMENT CONDITION — PRIZE RELEASE

The prize will NOT be released until settlement of the winner’s eligible property purchase has

occurred. For land and house packages, the prize will be released after practical completion of

the house construction with occupation certificate received and purchaser paid the final building construction cost to the builder. MQ Realty Pty Ltd will pay the vehicle price to the dealer and arrange

delivery only after the winner’s eligible property has settled / reached practical completion and paid full building cost.

 

  RULE 5 — ELIGIBILITY TO ENTER

 

5.1        To be eligible to receive a draw entry and to be eligible to claim the prize, ALL of the following conditions must be satisfied. Failure to satisfy any single condition results in automatic disqualification.

 

Condition 1 — Investors Club Membership

5.2        The participant must hold a current and valid MQ Realty Investors Club membership at the time of: (a) lodging the sales deposit; (b) executing the contract of sale; and (c) the draw date (31 March 2027).

5.3        MQ Realty Investors Club membership means a natural person who has: (a) completed the online registration at www.mqrealty.com.au; (b) been accepted as a member by the Promoter; and (c) is bound by the Investors Club Membership Terms and Conditions.

5.4        Membership must be active and in good standing at all relevant times. Suspended, cancelled, or revoked memberships do not qualify.

5.5        Membership registered after the participant’s deposit date for the purpose of retrospective qualification is not eligible. Membership must have been registered and accepted prior to the deposit lodgement.

5.6        Membership is personal to the registered individual. Corporate entities, trusts, and companies are not eligible as members. Where a property is purchased in the name of an entity, the draw entry may only be allocated to the individual natural person who is the registered Investors Club member and paid deposit at the time of membership.

 

Condition 2 — Eligible Property Purchase

5.7        The participant must purchase an eligible property being: (a) an off-the-plan apartment sold by MQ Realty Pty Ltd; or (b) a land and house package purchased from MQ Realty’s approved salesperson using MQ Realty’s marketed builder’s building contract, with the participant entering into a formal building contract and paying the full building deposit to the builder.

5.8        The eligible property must be situated within Australia.

5.9        The participant must lodge a valid sales deposit for the eligible property on or before 31 January 2027 at 12:00 pm AEDT into MQ Realty’s appointed trust account.

5.10      The participant must sign the binding contract of sale for the same eligible property and pay the required deposit to the seller on or before 28 February 2027 to enter the contract unconditionally.

5.11      The contract must be for the exact same property against which the deposit was lodged. No property substitution is permitted.

5.12      Deposits lodged but contracts not signed as unconditional by 28 February 2027 do not qualify for a draw entry regardless of whether the deposit remains held.

5.13      New Purchaser who purchases property that comes from buyer as re-sale or replacement of the original purchaser to any Projects (off the plan)or Land and House packages are NOT eligible.

 

 

Condition 3 — One Draw Entry Per Eligible Property

5.13      Each eligible property purchase generates one (1) draw entry ticket.

5.14      A participant who completes two (2) or more eligible purchases, each independently satisfying all eligibility conditions, receives one (1) draw entry per property purchased. For example: two qualifying purchases = two draw entries.

5.15      Multiple draw entries from the same participant increase the chance of winning but do not entitle the participant to multiple prizes. Only one (1) prize is available.

5.16      Draw entries are not cumulative across promotions and relate solely to this 2026 Promotion.

 

Condition 4 — Non-Transferability

5.17      Draw entries and the prize are strictly personal to the eligible Investors Club member and are non-transferable, except as provided in Rule 9 for Non-Resident Winners.

5.18      Draw entries and the prize cannot be transferred, assigned, sold, gifted, bequeathed, or passed to any other person, entity, trust, or company under any circumstances, except as provided in Rule 9.

5.19      Any attempt to transfer or deal in a draw entry or the prize (other than as permitted under Rule 9) will render the entry or prize null and void and immediately forfeited.

 

Condition 5 — Contract Must Proceed to Settlement

5.20      A draw entry remains valid only while the underlying contract of sale remains unconditional and on foot as at the draw date.

5.21      If a contract is rescinded, terminated, cancelled, or does not proceed to settlement for any reason — including exercise of a cooling-off right, finance failure, mutual termination, or default — the associated draw entry is automatically void and forfeited with immediate effect.

5.22      The Promoter reserves the right to verify the status of any contract at any time up to and including the draw date.

5.23      If a winning entry is subsequently found to relate to a voided contract, the prize will not be awarded, a redraw will be conducted, and NSW Fair Trading will be notified.

5.24      The prize will not be released until settlement of the eligible property purchase has occurred. For land and house packages, the prize will not be released until practical completion of the house construction and purchaser paid full construction cost to the builder.

 

Condition 6 — Additional Eligibility Requirements

5.25      The participant must be a natural person aged 18 years or older at the time of entry.

5.26      The participant must be legally entitled to purchase the eligible property under Australian law. Australian residency is not required to enter the Promotion.

5.27      Employees, directors, and immediate family members of MQ Realty Pty Ltd and associated entities are not eligible to participate if purchasing a property as their principal place of residence. However, employees, directors, and immediate family members who purchase properties for genuine investment purposes are eligible to participate.

5.28      The participant must purchase the eligible property through an MQ Realty Pty Ltd salesperson.

 

  RULE 6 — HOW TO ENTER

6.1        Entry into the Promotion is automatic upon satisfaction of all eligibility conditions in Rule 5.

6.2        The Promoter will generate and register each draw entry ticket upon confirming: (a) current Investors Club membership; (b) receipt of qualifying deposit on or before 31 January 2027; and (c) execution of binding contract on or before 28 February 2027.

6.3        Each participant will receive written confirmation of their draw entry ticket(s) including entry number(s).

6.4        The Promoter will maintain a secure draw entry register recording: (a) participant’s name and Investors Club membership number; (b) property address; (c) deposit date; (d) contract execution date; (e) draw entry number assigned.

6.5        The draw entry register is available for inspection by NSW Fair Trading upon request.

 

  RULE 7 — CONDUCT OF THE DRAW

7.1        The draw will be conducted on 31 March 2027 at 5:00 pm Sydney Time at MQ Realty Pty Ltd, Shop 207/62–80 Rowe Street, Eastwood NSW 2122, or such other location notified by the Promoter on its social media channels or by written notice to eligible participants prior to the draw date.

7.2        The draw will be conducted by a method of random selection from all valid and eligible draw entries registered as at the close of the Promotion Period (31 January 2027 at 12:00 pm Sydney time) and where contracts have been executed by 28 February 2027.

7.3        The draw will be overseen by an independent scrutineer who is not an employee, director, or associate of MQ Realty Pty Ltd.

7.4        The draw will be recorded by audio and visual means as evidence of the draw conduct and outcome.

7.5        Prior to declaring a winner, the Promoter will verify the eligibility of the drawn entry against the draw entry register and the underlying contract.

7.6        If the drawn entry is ineligible — whether discovered on the draw day or at any later time — a redraw will be conducted. NSW Fair Trading will be notified of any redraw.

7.7        The draw result is final and binding. No correspondence will be entered into regarding the draw outcome.

7.8        The Promoter will notify NSW Fair Trading of the draw outcome within seven (7) days of the draw date.

 

  RULE 8 — WINNER NOTIFICATION AND PRIZE CLAIM

8.1        The winner will be notified by telephone and registered email within five (5) business days of the draw date.

8.2        The winner must confirm acceptance of the prize in writing within twenty-one (21) calendar days of the first notification attempt.

8.3        If the winner cannot be contacted, does not respond, or does not accept the prize within twenty-one (21) calendar days of the first notification attempt, the Promoter will conduct a redraw. NSW Fair Trading will be notified of the unclaimed prize and the redraw.

8.4        To claim the prize, the winner must provide: (a) government-issued photo identification; (b) proof of current address; (c) written prize acceptance; and (d) all documentation required under Rule 9 if the winner is a non-resident.

8.5        The prize will not be released until settlement of the winner’s eligible property purchase has occurred, or in the case of a land and house package, after practical completion of the house construction and purchaser paid full construction cost to the builder.

8.6        The winner’s full name will be published on the MQ Realty website (www.mqrealty.com.au) and social media channels within seven (7) business days of the draw, as required by applicable NSW trade promotion requirements.

 

8.7        By entering the Promotion, participants consent to publication of their name and suburb as required by law, and to use of their name and image for promotional purposes connected with the Promotion.

 

  RULE 9 — NON-RESIDENT AND OVERSEAS WINNERS

9.1        A Non-Resident Winner is a winner who, at the draw date, is physically located outside Australia or does not hold a current Australian residential address for the purpose of NSW motor vehicle registration under the Road Transport Act 2013 (NSW).

9.2        Australian residency is not required to enter the Promotion. However, a Non-Resident Winner must select one of the following three (3) approved prize delivery methods within sixty (60) calendar days of notification:

 

Method A — Appointment of Australian Power of Attorney Representative (Preferred)

What it is The winner appoints a trusted Australian-resident individual to accept, register, and hold the vehicle in Australia on the winner’s behalf via a duly executed Power of Attorney.
How it works The winner provides a certified Australian Power of Attorney (POA) authorising an Australian-resident agent to: (a) accept the prize vehicle; (b) pay all on-road costs including stamp duty, registration, and CTP; (c) hold or use the vehicle as directed by the winner.
Winner’s obligations Provide a certified POA to the Promoter prior to vehicle handover. The POA representative must provide valid Australian photo ID, a current Australian residential address, and a Tax File Number (TFN) if required for any ATO tax obligation arising from the prize. Winner must complete the Promoter’s POA form before the prize is released.
On-road costs All on-road costs (stamp duty, registration, CTP, comprehensive insurance) are the winner’s or their POA representative’s sole responsibility.
Best suited for Overseas winners with a family member, business associate, or legal representative in Australia.

 

Method B — Deferred Collection (Winner Returns to Australia)

What it is The winner defers collection until they return to Australia in person.
How it works The Promoter will hold a confirmed prize allocation (vehicle voucher or dealer reservation) for up to twelve (12) months from the draw date. The winner must collect or nominate an alternative method within this period.
Time limit If the winner does not collect or nominate an alternative method within twelve (12) months from the draw date, the prize converts to Method C (Cash Equivalent). The prize cap remains AUD $50,000 incl. GST regardless of any increase in vehicle price at the later delivery date. Any price increase above the cap at the time of delivery is borne solely by the winner.
Winner’s obligations Notify the Promoter at least 30 days before intended collection date. Present valid ID and a current Australian address for registration upon collection.
On-road costs All on-road costs remain the winner’s sole responsibility upon collection.
Best suited for Overseas winners planning to return to Australia within 12 months of the draw date.

 

Method C — Cash Equivalent (Default if No Method Nominated Within 60 Days)

What it is The Promoter converts the prize to a cash equivalent in AUD and remits the net amount by international bank transfer.
Amount calculation An independent licensed dealer valuation is obtained. The cash equivalent payable is the dealer valuation (capped at $50,000 incl. GST) LESS: (a) applicable Australian withholding tax (if required by ATO); (b) international wire transfer and bank charges; (c) any currency conversion costs; (d) administrative handling fee of AUD $2,000. All such deductions are the winner’s sole responsibility; (e) GST deduction.
Withholding tax The Promoter will withhold and remit to the ATO any amounts legally required. The winner receives the net amount after all deductions.
Currency Payment in Australian Dollars (AUD). Currency conversion is entirely the winner’s risk and cost.
Bank details Winner must provide within 30 days of notification: full account name (must match the name on the sales contract), bank name and address, SWIFT/BIC code, and IBAN or account number. The Promoter accepts no liability for funds lost due to incorrect details.
When applied Automatically if: (a) no method nominated within 60 days; (b) Method B 12-month period lapses; or (c) winner expressly selects this method.

 

⚠  TAX NOTICE — NON-RESIDENT WINNERS

Non-resident winners may have tax obligations in both Australia and their country of residence.

Withholding tax rates depend on applicable double tax treaties. The Promoter strongly recommends

non-resident winners seek independent tax advice from both an Australian registered tax agent

and a tax professional in their country of residence before selecting a delivery method.

The Promoter accepts no liability for any tax assessed in any jurisdiction.

 

9.3        Documentation required from Non-Resident Winners within 60 calendar days of notification: (a) certified copy of current passport; (b) proof of overseas residential address dated within 3 months; (c) completed MQ Realty Prize Acceptance Form; (d) written nomination of selected method (A, B, or C); (e) for Method A: certified POA document and ID of nominated POA representative; (f) for Method C: full international bank account details, with bank account name matching the name on the sales contract.

9.4        Failure to provide required documentation within 60 calendar days results in automatic default to Method C, with a further 30 days to provide bank details. If bank details are not received within the extended period, the prize is forfeited and a redraw is conducted. NSW Fair Trading will be notified.

  RULE 10 — PRIVACY

10.1      Personal information collected from participants will be handled in accordance with the Privacy Act 1988 (Cth) and the MQ Realty Pty Ltd Privacy Policy (www.mqrealty.com.au).

10.2      Information will be used for: (a) administering the Promotion; (b) verifying eligibility; (c) conducting the draw; (d) notifying and delivering the prize; (e) publishing winner details as required by NSW trade promotion requirements; and (f) contacting participants about future investment opportunities and Investors Club events unless the participant opts out in writing.

10.3      Participants may request access to, or correction of, their personal information by contacting the Promoter in writing.

 

  RULE 11 — TAX OBLIGATIONS

11.1      If any tax is applicable to the winner, the winner is solely responsible for all tax obligations arising from receipt of the prize, including any income tax assessed by the ATO.

11.2      Non-resident winners may be subject to Australian withholding tax. The Promoter will withhold and remit to the ATO any amounts legally required.

11.3      The Promoter will comply with all applicable GST obligations under the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

11.4      The Promoter strongly recommends that all winners seek independent financial and tax advice before accepting the prize.

 

  RULE 12 — GENERAL CONDITIONS

12.1      The Promoter reserves the right to verify eligibility at any time, including by requesting deposit receipts, contracts of sale, Investors Club membership confirmation, building contracts (for land and house packages), and government-issued identification.

12.2      The Promoter reserves the right to disqualify any participant who: (a) provides false or misleading information; (b) tampers with the entry process; (c) breaches these Gaming Rules; or (d) engages in conduct contrary to the spirit of the Promotion.

12.3      The Promoter reserves the right to cancel, suspend, or vary the Promotion due to circumstances beyond its reasonable control, including Acts of God, natural disaster, government direction, pandemic, or force majeure, in accordance with applicable NSW trade promotion requirements.

12.4      The Promoter is not responsible for: (a) lost, delayed, or misdirected communications; (b) failure of technology; or (c) any injury, loss, or damage arising from participation or acceptance of the prize.

12.5      These Gaming Rules are governed by the laws of New South Wales, Australia. Any dispute is subject to the exclusive jurisdiction of the NSW courts.

12.6      These Gaming Rules are to be read in conjunction with the Promotion’s full Terms and Conditions published at www.mqrealty.com.au. In the event of any inconsistency, these Gaming Rules prevail.

12.7      Entry constitutes full and unconditional acceptance of these Gaming Rules and the Promotion Terms and Conditions.

 

  RULE 13A — MANNER OF RESOLVING DISPUTES

This Rule sets out the manner in which disputes concerning the conduct of this trade promotion lottery or the claiming of a prize are to be resolved, as required by the Community Gaming Regulation 2020 (NSW).

13A.1  How to Lodge a Dispute

13A.1.1 Any participant who wishes to dispute any aspect of this Promotion — including but not limited to the conduct of the draw, an eligibility determination, prize delivery, or a prize claim — must submit their dispute in writing to the Promoter by below email and also over the phone by below number:

13A.2  Timeframe to Lodge

13A.2.1 Disputes must be lodged in writing within seven (7) calendar days of the date the disputed event occurred, including the draw date, notification date, or prize delivery date.

13A.2.2 The written dispute must include: (a) full name and Investors Club membership name and email ; (b) property address and draw entry number; (c) clear description of the dispute; and (d) any supporting documentation.

13A.2.3 Disputes lodged outside the 7 day period or not submitted in writing may not be considered.

 

13A.3  Internal Resolution — Three Steps

3 Final Internal Decision Licensee-in-Charge decision is final internal determination. Promoter will comply with any NSW Fair Trading or court direction. Final and binding unless overturned by NSW Fair Trading or a court.

 

13A.4  External Escalation

13A.4.1 If not satisfied with the Promoter’s final internal determination, participants may escalate to:

13A.4.2 The Promoter will cooperate fully with any inquiry by NSW Fair Trading, NCAT, or any relevant regulatory authority.

13A.5  Draw and Eligibility Decisions

13A.5.1 The Promoter’s decisions on draw conduct, winner selection, and participant eligibility are final and binding, subject to any contrary determination by NSW Fair Trading or other government organisation.

13A.5.2 The independent scrutineer’s confirmation of the draw result is conclusive for the purpose of determining the prize winner.

13A.5.3 No participant may require the draw to be re-conducted except as expressly provided in these Gaming Rules or as directed by NSW Fair Trading.

13A.6  Record-Keeping

13A.6.1 The Promoter will maintain written records of all disputes, the steps taken, and outcomes for a minimum of twelve (12) months from the draw date (31 March 2027), available to NSW Fair Trading on request.

13A.7  Australian Consumer Law

13A.7.1 Nothing in this Rule limits any rights a participant may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law.

13A.7.2 The Promoter will not engage in conduct that is misleading, deceptive, or unconscionable in connection with administering this Promotion or handling disputes.

 

DISPUTE RESOLUTION SUMMARY — FOR FORM FIELD USE

Step 1: Submit written dispute to investors@mqrealty.com.au and admin@mqrealty.com.au within 7 days of the disputed event.

Step 2: Promoter acknowledges within 5 business days; resolves within 14 business days.

Step 3: If unresolved, escalated to Licensee-in-Charge for final decision within 20 business days.

Step 4: If still unresolved, participant may contact NSW Fair Trading (13 32 20)

Draw conduct and eligibility decisions are final and binding subject to NSW Fair Trading direction.
